Turning a Competitor’s Lies into Life Altering Award
(Valuation Analysis) – A Janas client was the Plaintiff in a suit in a larger competitor directed its sales force to make untrue and defamatory statements about our client and its products. The client had identified a direct damage amount based on profit margins on lost sales. Janas recommended that damages should be based on the loss in Enterprise Value to the owner. Counsel followed that suggestion and obtained a settlement three times more than what counsel originally projected. This damage award was used by our client to launch a new product line that catapulted his company into a leadership position in the industry.
